Suspensions and Cancellations - Only One Party Applying

Forms VT13 (PDF 159KB) or VT16 (PDF 159KB) are not to be used when only one party is applying to suspend or cancel a training contract. In that case the person should be advised to make application in writing to the Commissioner, giving reasons for the suspension or cancellation. The use of pro- forma’s is to be discouraged.

If only one party applies for a suspension or cancellation a 21-day letter must be immediately sent to the other party to the training contract. At the same time reasonable steps are to be taken to speak to the other party to determine whether they consent to the application. The objective is to determine as soon as possible issues which may lead to a dispute and increase the chances of conciliation.

Details of action to contact the parties and their outcome of these are to be noted on the file.
